A devious cabal that included a pedophile rabbi stole a half-million-dollar home from a cancer-stricken woman, using a forged power of attorney to sell it and pocket the profits, Brooklyn prosecutors charged yesterday.
According to investigators, Margaret Franklin's Crown Heights home was stolen in August 2004 after Nathen Farkas, 31, forged a power of attorney, signing Franklin's name, that effectively handed control of her assets to co-defendant Russell Pitt.
The power of attorney was notarized by a third defendant, Jerry Brauner, 53, a rabbi who had been on probation since 2002 for the sexual abuse of a 15-year-old boy.
Pitt then "sold" the property to the fourth defendant, Winston Roche, 59, and a $476,000 mortgage was split among Roche, Pitt and Farkas.
"Margaret Franklin never got a nickel," said Assistant DA Michael Vaccaro. "Then she died."
Farkas was ordered held in lieu of $85,000 bail and Roche on $45,000. Pitt is still at large.
Brauner was held in lieu of $85,000 bail for lying about prior sex-abuse convictions when he applied for his notary's license.
Lawyers for the three men arraigned yesterday denied that their clients knew anything sinister was going on, suggesting Pitt was the mastermind.

The indictment charges that in September 2004, Nathan Farkas and Pitt sold the home to Winston Roche, 59. However, Roche was allegedly involved in the criminal conspiracy, and he and the other defendants divided the $476,000 mortgage. The woman died in 2005.
Prosecutors said that one defendant, Jerry Brauner, 53, who notarized the power of attorney, is charged with falsifying a notary public renewal application, in which he denied that he was a convicted felon.
At their arraignments, Farkas, 31, and Brauner were held in lieu of $85,000 bail. Roche's bail was set at $45,000. Pitt remains at large.
Brauner is charged with first degree offering a false instrument.. Charges against Farkas, Roche and Pitt include second degree grand larceny, fourth degree conspiracy and second degree forgery.

Convicted sex offender Yechiel Brauner is back on the streets again after his latest arrest. Brauner who is currently on probation for fondling a 15 year-old boy in a hearst on the way to his grandmother's levaya is now again in trouble for allgedly falsifying documents, conspiring to rob a dying old woman of her home and for failing to report that he was a sex offender when he applied for his notary public. Brauner was released on $85,000 bail and was leibing and laching again. To add insult to injury, Brauner davened Mincha this Erev Shabbos for the Umed.

The defendants are charged with forging documents to give defendant Russell Pitt power of attorney over a building the woman owned at 39 Herkimer St. in Bedford-Stuyvesant.
The indictment charges that in September 2004, Pitt and Nathen Farkas sold the home to Winston Roche. Roche, who is also charged in the scheme, allegedly divided the $476,000 mortgage with the other defendants. The woman died in 2005.
Defendant Jerry Brauner, who notarized Pitt's power of attorney, is charged with falsifying a notary public renewal application in which he denied that he was a convicted felon.
At their arraignments Wednesday, Farkas, 31, and Brauner, 53, were held in lieu of $85,000 bail. Bail for Roche, 59, was set at $45,000. Police are still searching for Pitt.
Brauner is charged with offering a false instrument for filing. Charges against Farkas, Roche, and Pitt include second-degree grand larceny, fourth-degree conspiracy and second-degree forgery.
Assistant District Attorney Michael Vaccaro is prosecuting the case for the Kings County District Attorney's Office.

The car is a light blue late 90's model Mercury Grand Marquis with the license plate number BHZ 5385. There is a handicap permit hanging from the rear-view mirror and the back lights of the car are broken and have lens tape on them. Warn your children and teenagers not to accept any rides from the man driving this car.
